NASHVILLE, Tenn. (WKRN) – An attorney for Nashville Mayor Megan Barry said she has given the Tennessee Bureau of Investigation the passcode to her personal cell phone.

In a statement her attorney, Jerry Martin said, “This morning I spoke with TBI Director Mark Gwyn to provide the TBI with the passcode for Mayor Barry’s personal phone. This is her personal phone, not her Metro issued phone.”

Martin said he has confidence in the agency that it will limit its search of her personal phone to “only items that are relevant to its investigation.”

Barry’s attorney added that the mayor has provided the TBI with thousands of pages of documents at its request.

“Simply put, the mayor continues to cooperate with the investigation and knows eventually she will be cleared of any criminal wrongdoing,” Martin said. Click here to read the full statement. 

Also on Friday, the mayor asked for District Attorney Glenn Funk to recuse himself from the investigation into her affair.

“Glenn Funk raised this issue to my attorney last week. He was concerned about potential conflict of interest,” Barry said.  “We took that very seriously when he said that and we did our due diligence. We got the head of the Tennessee Bar Association to give an opinion on that. He absolutely says Glenn has a conflict and recuse and that this precedence out there on other case law. We take that very seriously. We wanted that opinion and because Glenn had raised it.”

Funk has since commented, saying, “When the TBI investigation is complete, I will fulfill and perform the requirements of my office. Until that occurs, this office will not have public comment so as to not interfere with the TBI investigation.”

The investigation began after Barry admitted to the public on Jan. 31 that she had an extramarital affair with her former head of security, Sgt. Robert Forrest. The relationship, she said was consensual, and began shortly after she took office in 2015.

She said nothing illegal took place during the affair and that the relationship with Forrest has since ended.

Barry has remained adamant that she will not resign from her position as mayor.

“I have lots of work to do in this city and every day I get up and I do it,” she said. “I’ve been very forthcoming with everything. I think the citizens of Davidson County continue to want us to get up every day and work. I have a great team, we have great Metro employees that get up every day to make sure this city runs, and I’m going to continue to lead that.”

On Thursday, search warrants were released to the media that detailed nude photos, travel and overtime pay. Mayor Barry said hours after the documents were released that if there are nude photos of her they were taken without her consent.

“I have not seen these pictures. I don’t know what they are. I don’t know what they look like, but I will tell you, if they were taken of me they were taken without my permission,” she told the media.

Barry also said the search warrants were made public on Thursday as a way to “embarrass her politically.”

“It should have been sealed until the end of this investigation – that it was completely designed to humiliate me and politically embarrass me, so therefore it’s clear that I have to make sure that I’m protecting my personal rights as we move through this,” she said.Click here for complete coverage of Nashville Mayor Megan Barry.
