Vanderbilt rape suspect booked on new charge in Nashville

NASHVILLE, Tenn. - Former Vanderbilt University football player Brandon Vandenburg traveled from California to Nashville this week where he was booked on a new charge stemming from his rape arrest last summer.

News 2 spoke with his attorney, John Herbison, who said, “[Vandenburg] was originally charged with a multiple count indictment in August of last year. The state is going to be asking to dismiss one of those several counts and have that count superseded, [or] replaced with a new charge.”

Vandenburg arrived to the Criminal Justice Center around 3:30 p.m. on Friday. He was booked on a new charge of tampering with evidence and released just after 8 p.m.

Vandenburg will appear in Judge Monte Watkin’s court on Monday to be arraigned on the new charge. A motion by the defense team to disqualify the office of the district attorney from the case will also be heard.

Vandenburg and former teammates Brandon Banks, Cory Batey, and Jaborian "Tip" McKenzie are each charged with five counts of aggravated rape and two counts of aggravated sexual battery for the alleged rape which took place in Vandenburg’s on-campus dorm room in June of 2013.

Vandenburg is additionally charged with one count of unlawful photography.

All four have since pleaded not guilty and are out of jail on bond.
