NOLENSVILLE, Tenn. - The criminal case against a Nolensville mother whose son went missing for nearly a week earlier this year has been dismissed after it was revealed her son is not a juvenile as previously thought.

Susan Smithburg was arrested April 2, one day after her son Christopher was found following an extensive, six-day search in Williamson and Rutherford counties.

During a preliminary hearing Wednesday it was revealed in a Perry Mason moment that Christopher is 18 years old and a legal adult. It was previously thought he was just 16 years old.

Because he is 18, the judge ruled the case is not a juvenile case and dropped the charges.

Susan Smithburg faced child abuse and neglect charges for forcing Christopher to do 1,500 push-ups as punishment for lying about cooking a piece of toast.

Christopher was adopted from the Philippines several years ago.

Two other children, a 17-year-old boy and 10-year-old girl, were removed from the home at the time of Susan Smithburg’s arrest.
