The Clarksville-Montgomery County School System will pay a student $260,000 following a lawsuit filed by his parents.
According to the Leaf Chronicle, the lawsuit stemmed from an incident on September 26, 2011. Matthew Kurtz, now 15, was injured when he tripped over a pencil while trying out for the basketball team at West Creek Middle School.
He broke his right femur and had to undergo surgery to repair the injury.
Kurtz’s parents, Todd and Sandra, filed a civil suit through their attorney, Pete Olson, claiming negligence by the school system because they did not have a safe gymnasium.
The settlement was filed in the Montgomery County Circuit Courts Thursday. It covered more than $90,000 in medical expenses and attorney fees.
The school system’s liability insurance will take care of all but about $10,000 of the settlement.
