$3 million lawsuit filed by family of man killed in construction accident

HENDERSONVILLE, Tenn. -

A $3-million lawsuit has been filed by the family of a man killed during the construction of a Hendersonville building last April.  

Jose Velasco-Sanaugustin was working at the construction site just off Indian Road when he was one of two men who died when a wall collapsed on top of them.

The suit was filed by the 37-year-old man's wife Maria, their three children and a nephew against three sub-contractors at the construction site.

One of the main allegations contends that Tayes Masonry, N&S Waterproofing, LLC and Beaver Engineering Inc. were "negligent" and "failed to utilize safe and proper construction techniques."

An attorney for the Velasco family told News 2 that one of the areas of "negligence" was in the bracing used to support the wall that collapsed.

"They needed more of them," said Nathan Coburn who is one of two attorneys who filed the lawsuit for the Velasco family.

News 2 reached the owner of Tayes Masonry, which is one of the three companies named in the lawsuit.

He cited a state TOSHA report on the incident which he said "someone took the braces off. We don't know who."

An executive with one of the other three companies named in the filing told News 2 he had not seen the lawsuit.

The third company did not comment.
