NASHVILLE, Tenn. -

A Nashville firefighter has been fired for having sex at fire stations while on duty, something the president of the local firefighters' union says there is no evidence to prove.

The Nashville Fire Department began investigating 28-year-old Joel Mitchell in December after learning he allegedly had consensual sex while working at a fire station other than his own.

During their investigation, Deputy Kim Lawson said officials learned the complainant had also visited Mitchell's normally assigned station on other occasions.

Mitchell, a six-year veteran of the fire department, was fired Friday, three days after a panel met and determined his behavior was grounds for termination.

News 2 reached out to Mitchell by phone, but he responded with a text saying he would let the firefighters' union handle any statements.

In a statement, Mark Young, president of the IAFF Local 140, the union that represents Nashville's firefighters, called Mitchell's termination a "case of revenge."

He said the investigation into Mitchell shows no evidence of wrong doing or evidence that would warrant termination.

"This is all coming from a former co-worker and her current boyfriend.  Mitchell had worked with her at another place of employment," Young wrote. "The complainant's boyfriend has made known that he is set out to do whatever possible to ruin the career of Mitchell."

Young continued, "This is very hard on Joel. This is hard on his family. This should not be a case that we're fighting for termination," Young said.

Young said they have started the appeal process and strongly believe the case will be overturned.

Mitchell was an agent for Village Real Estate Services. News 2 has confirmed he is no longer an employee.
