Former Vanderbilt football player charged with rape appears in court

NASHVILLE, Tenn. -

One of the four former Vanderbilt University football players charged in an on-campus rape appeared before a judge Wednesday.

The hearing focused on the appearance of one of Brandon Vandenburg's attorneys.

A judge decided during the motions hearing that Vandenburg's local attorneys will need to file a formal motion to sponsor an out-of-state attorney.

That attorney, Albert Perez, had been sponsored by a lawyer who had previously represented Vandenburg.

Prosecutors argue the issue is important to prevent a possible mistrial.

Vandenburg is currently living with his family in California.

He and former teammates Brandon Banks, Cory Batey and Jaborian "Tip" McKenzie are charged with five counts of aggravated rape and two counts of aggravated sexual battery from the allege incident that occurred in June.

Vandenburg is additionally charged with unlawful photography and tampering with evidence.

All four have since been kicked off Vanderbilt's football team.  They have pleaded not guilty to the crime and are out of jail on bond.

An August 11 trial date has been set for Vandenburg and Batey.
