MEMPHIS, Tenn. (AP) - A federal judge has set a trial date for a National Guard recruiter charged with trying to kill four of his superiors at a West Tennessee armory.

The Commercial Appeal reports that U.S. District Judge John T. Fowlkes Jr. scheduled the trial to begin on Feb. 10 in an attempt to prod the FBI lab to complete its processing of the gun, bullets and other evidence from the crime scene.

Prosecutors say Amos Patton opened fire inside the armory in Millington on Oct. 24 after he was told he would be relieved of duty and dismissed from active service for alleged misconduct. Patton has pleaded not guilty.

Prosecutor Fred Godwin said in court Friday that the FBI prioritizes lab work based on trial dates.
