Iraq veteran wins appeal against Nashville police

NASHVILLE, Tenn. (AP) - An Iraq war veteran who filed a lawsuit against the Metro Nashville police department for reassigning him and then firing him after a deployment has won an appeal over back pay and damages.

Brian Petty, a former Army reservist, sued the police in 2005 for putting him on a desk job rather than his previous patrol sergeant position in violation of the Uniformed Services Employment and Reemployment Rights Act.

He was later terminated from the department on charges of submitting false or inaccurate reports and violating department policy on being honest and truthful about a military investigation into alcohol possession while he was in Kuwait.

The 6th Circuit Court of Appeals issued a ruling Tuesday that upheld the district court's awarding of back pay and damages to Petty.
