TN court of appeals judge charged with DUI

KNOXVILLE, Tenn. -

A Tennessee Court of Criminal Appeals judge from Nashville was arrested Monday night in Knoxville and charged with driving under the influence.

According to The Tennessean, Judge Jerry L. Smith was pulled over after a Knoxville police sergeant spotted his car with its rear hatch open and a piece of luggage on the verge of falling out.

Citing court records, the paper reported the driver had a strong odor of alcohol, slurred speech and was unable to perform standard field sobriety tests.  He also refused a blood alcohol test.

Smith, 58, was charged with driving under the influence and violation of the implied consent law.

Smith has been on the Court of Criminal Appeals since 1995.

Prior to that, he served as a deputy attorney general from 1989 to 1995 and an assistant attorney general from 1982 to 1989, according to his biography posted on the state Administrative Office of the Courts Web site.
