Former executor indicted in theft from estate

NASHVILLE, Tenn. (AP) - The executor of an estate left to benefit a children's home in Middle Tennessee has been indicted on charges that he stole money from it.

Daryl Bornstein faces nine state felony counts and his wife, Janalyn Bornstein faces five counts, The Tennessean reported.

Daryl Bornstein was the executor of an estate valued at $800,000 left by Metro Nashville firefighter Raymond Simmons, who died in 2006.

Simmons intended his estate to benefit the Tennessee Children's Home in Spring Hill.

A probate court removed Bornstein as the executor last year.

An official of the children's home says only about $50,000 of the estate was left then.

The indictments against the Bornsteins were returned on Friday.  Arraignment has not yet been scheduled.
