The wife of murdered Nashville attorney James Cannon was arrested and charged with his murder Thursday morning.

Kelley Cannon was taken into custody from her mother's home just before 9 a.m.

Police said evidence collected from James Cannon's Bowling Avenue home implicates the 41-year-old.

"As a result of the scientific analysis of evidence, Ms. Cannon was implicated in the death of her husband," said Metro police spokesperson Don Aaron.

A housekeeper found James Cannon strangled to death in an upstairs closet of the home on the morning of June 23.

The same morning, the couple's three children, aged nine, seven and 18-months, were found with Kelley Cannon, although a court order prohibited her from having contact with them.

Kelley Cannon was arrested three days later on three counts of criminal contempt for violating an order of protection.

Last week, she appeared in court on the charges.  Afterwards, she told a group of reporters, "I'm devastated by all this."

Friends and family said the couple was going through a contentious divorce.

In May, James Cannon had filed the order of protection against his wife after she tried to take the couple's youngest child.

The two where last seen together outside James Cannon's home the night before he was found dead.

Kelley Cannon told detectives she was at her husband's home sometime between 10 p.m. and Midnight that Sunday and that the back door was slightly open and the lights were on.  She went on to say she woke up her children and took them to her home.

Cannon's mother, Diane Sanders, maintains her daughter is innocent.  Sanders too said all the lights were on in the Cannon home and the door was open when her daughter went to pick up her children.

She claims Kelley Cannon got her children and left.  She said she was afraid to call the police because of a protection order against her.

Acting on a search warrant last week, detectives seized clothes and an empty carton of Virginia Slims cigarettes for Kelley Cannon's home.  They also collected a swab of her saliva and sent it to the TBI crime lab.

Kelley Cannon was scheduled to appear in court later Thursday for a custody hearing.

The couple's children are currently in the custody of James Cannon's sister.
